Justices to clarify laws pertaining to the removal of non-citizens.
The Supreme Court heard oral arguments in the case of Pham. v. Chavez on Monday. This case deals with particulars pertaining to immigration law in the United States. Generally, removal orders, wherein individuals are deported from the country, are not able to be appealed. However, if the person is afraid of facing persecution or violence in their home country they can seek withholding of their removal.
The respondents of this case are subject to such a removal order, and the government argued that they couldn’t have a bond hearing under 8 U.S.C. § 1231, however, the noncitizens argued that 8 U.S.C. § 1226, rather than 8 U.S.C. § 1231 applies to their case. The Supreme Court will rule which section of the law applied to people in the respondents’ situation.
